These Terms of Use ("Terms") govern your use of the DMV Practice Test & Tracker mobile application (the "App") provided by FREE VPN SERVICES LIMITED, 71-75 Shelton Street, Covent Garden, London WC2H 9JQ, United Kingdom ("we", "us", "our"). By downloading or using the App you agree to these Terms. If you do not agree, do not use the App.
If you downloaded the App from the Apple App Store, these Terms apply together with Apple's Licensed Application End User License Agreement (https://www.apple.com/legal/internet-services/itunes/dev/stdeula/). If there is a conflict, these Terms apply to the extent permitted by Apple's terms.
1. Not affiliated with any government agency
The App is an independent study tool. It is not affiliated with, endorsed by, or connected to any Department of Motor Vehicles (DMV), state agency or other government body. Practice questions, lessons and videos are based on publicly available driver handbooks and are provided for educational purposes only. Always rely on your official state driver handbook and your local DMV for current rules, requirements and test information. Passing practice tests in the App does not guarantee that you will pass an official exam.
2. License
We grant you a personal, non-exclusive, non-transferable, revocable license to use the App on devices you own or control, for your own non-commercial use, in accordance with these Terms and the rules of the app store you downloaded it from. You may not copy, modify, distribute, sell, reverse-engineer or create derivative works from the App or its content, except where the law expressly permits it.
3. Subscriptions and payments
Some content and features require a paid subscription ("Premium").
- Payment. Payment is charged to your Apple ID (or Google Play account) when you confirm the purchase.
- Automatic renewal. Subscriptions renew automatically at the end of each period (e.g. weekly, monthly or every 6 months) at the then-current price, unless auto-renew is turned off at least 24 hours before the end of the current period. Your account will be charged for renewal within 24 hours before the end of the current period.
- Free trials. If a free trial is offered, you will be charged the subscription price when the trial ends unless you cancel at least 24 hours before it ends. Any unused part of a free trial is forfeited when you purchase a subscription.
- Managing and cancelling. You can manage or cancel your subscription in your device's account settings (iOS: Settings → [your name] → Subscriptions). Deleting the App does not cancel a subscription.
- Refunds. Payments are handled by Apple or Google, and refund requests are subject to their policies. For App Store purchases, you can request a refund at https://reportaproblem.apple.com.
- Price changes. We may change subscription prices. You will be notified in advance as required by the app store, and you can cancel before the new price applies.
- Restoring purchases. If you reinstall the App or change devices, use "Restore purchase" in the App to regain access to an active subscription.
4. Acceptable use
You agree not to misuse the App, including by attempting to gain unauthorised access to our systems, interfering with the App's operation, circumventing payment or access controls, scraping or bulk-copying content, or using the App for any unlawful purpose.
5. Intellectual property
The App and its content (including questions, explanations, lessons, illustrations, videos, design and software) are owned by us or our licensors and are protected by intellectual property laws. Official handbook material referenced in the App remains the property of its respective owners.

7. Disclaimers
The App is provided "as is" and "as available". To the fullest extent permitted by law, we make no warranties that the content is complete, accurate or up to date, or that the App will be uninterrupted or error-free. Traffic laws and test formats change; verify important information with your local DMV.
8. Limitation of liability
To the fullest extent permitted by law, we will not be liable for any indirect, incidental, special or consequential damages, or for any loss arising from reliance on the App's content, including failing an official test. Our total liability for any claim relating to the App is limited to the amount you paid us for the App in the 12 months before the claim. Nothing in these Terms limits liability that cannot be limited by law, or your statutory rights as a consumer.
9. Termination
We may suspend or terminate your access to the App if you breach these Terms. You may stop using the App at any time. Sections that by their nature should survive termination will survive.
10. Changes
We may update these Terms from time to time. We will post the updated version at this address and change the "Last updated" date. Continued use of the App after changes take effect means you accept the updated Terms.
11. Governing law
These Terms are governed by the laws of England and Wales. If you are a consumer, you also benefit from any mandatory protections of the law of the country where you live, and you may bring proceedings in your local courts.
